These Terms of Service ("Terms") are a binding agreement between you and Light 2 Minds ("Light 2 Minds," "we," "us," or "our"), governing your access to and use of light2minds.com (the "Site"), and any products, digital resources, courses, or consultation services we offer (collectively, the "Services").

By accessing or using the Site or Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Site or Services.

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products or services or to enter into a binding agreement with us. By using the Site, you represent that you meet this requirement. The Site and Services are intended for parents, caregivers, educators, and behavioral health professionals, and are not directed at children.

You agree to use the Site responsibly and in accordance with all applicable laws. When using the Site, you agree not to:

We reserve the right to modify, discontinue, or limit availability of any product or Service at any time without liability to you.

Information provided through the Site, courses, study guides, consultations, blog content, and resources is intended for educational and informational purposes only. We do not guarantee certification exam results, professional licensure outcomes, employment opportunities, clinical outcomes, or academic success.

Light 2 Minds is not a medical or mental health provider. Our products, resources, consultations, and educational content are not intended to diagnose, treat, cure, or prevent any medical, psychological, or developmental condition, and are not a substitute for professional medical or clinical advice. Digital products, online courses, study guides, flashcards, and downloadable resources are licensed to you for personal, non-commercial use only. You may not copy, share, distribute, sublicense, or resell this content. We may revoke access if we reasonably believe these Terms have been violated.

All content on the Site — including logos, branding, study guides, courses, downloads, graphics, and educational materials — is the property of Light 2 Minds or its licensors and is protected by U.S. and international intellectual property laws. No rights are granted to you other than the limited license expressly stated in these Terms.

By placing an order, you represent that all billing and account information you provide is accurate and current. We reserve the right to refuse or cancel any order, correct pricing or listing errors, and investigate suspected fraudulent activity. Prices are subject to change without notice.

Purchases of physical products are subject to our Shipping & Return Policy. Digital products and online courses are generally non-refundable due to immediate access to content, as described in that policy.

The Site may contain links to third-party websites, platforms, or services (including payment processors and course hosting platforms) that are not owned or controlled by Light 2 Minds. We are not responsible for the content, accuracy, privacy practices, or policies of any third-party site.

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

To the fullest extent permitted by law, Light 2 Minds and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Site, products, Services, or educational content, even if advised of the possibility of such damages. In no event shall our total aggregate liability to you exceed the amount you paid to Light 2 Minds in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Light 2 Minds and its owners, employees, and contractors from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site or Services, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.

Binding Arbitration Agreement. You and Light 2 Minds agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and shall take place in Palm Beach County, Florida, or another mutually agreed location, or may be conducted by telephone or based on written submissions where permitted by the AAA rules.

Class Action Waiver. You and Light 2 Minds agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, collective, or representative action. Neither party may participate in a class action, and the arbitrator may not consolidate more than one party's claims.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@light2minds.com within thirty (30) days of first accepting these Terms, stating your name and a clear statement that you wish to opt out of arbitration.

Light 2 Minds shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, carrier delays, supply chain disruptions, or governmental action.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy and Shipping & Return Policy, constitute the entire agreement between you and Light 2 Minds regarding the Site and Services.

No Waiver. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

We may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
